מגזין הכיבוש - מסמכים, נתונים עמוד הבית  חזרה הדפס  שלח לחבר "בית המשפט נתן חותמת הכשר לנהלים פגומים ולא חוקיים, אשר לא הגנו על חיי אזרחים" - הצהרתו של עו"ד חוסיין אבו חוסיין בתגובה לפסק הדין בתביעת הנזיקין של משפחת רייצ`ל קורי `בית המשפט נתן חותמת הכשר לנהלים פגומים ולא חוקיים, אשר לא הגנו על חיי אזרחים` - הצהרתו של עו`ד חוסיין אבו חוסיין בתגובה לפסק הדין בתביעת הנזיקין של משפחת רייצ`ל קורי (חיפה, 28 באוגוסט 2012) – אם כי אינו מפתיע, פסק הדין הזה הוא עוד דוגמה למצב שבו המדיניות של פטור מעונש גברה על עקרונות לקיחת האחריות וההגינות. רייצ`ל קורי נהרגה בזמן שקיימה מחאה בלתי אלימה נגד הריסת בתים ואי צדק ברצועת עזהץ היום, בית המשפט נתן חותמת הכשר לנהלים פגומים ולא חוקיים, אשר לא הגנו על חיי אזרחים. פסק הדין מאשים את הקורבן בהסתמך על עובדות מעוותות. הוא יכול היה להיכתב ישירות בידי פרקליטות המדינה. ידענו מההתחלה שאנו נמצאים במאבק קשה מאד, בנסיוננו לקבל תשובות אמת ולהשיג צדק, אך אנו משוכנעים שפסק הדין הזה מעוות את הראיות החזקות שהוצגו בבית המשפט, ועומד בסתירה לעקרונות יסוד של המשפט הבינלאומי הנוגעים להגנה על מגיני זכויות אדם. פסק הדין מונע עשית צדק בפרשת בהריגתה של רייצ`ל קורי, ובכך הוא מעיד על כשל מערכתי וחוסר יכולת לתבוע מהמערכת הצבאית בישראל לשאת באחריות להמשך ההפרות של זכויות האדם הבסיסיות. ברצוננו להודות לכל מי שתמך במשפחה ובצוות המשפטי; כולל פעילים, עמותות, משקיפים משפטיים, אנשי בשגרירות ארה`ב, מתורגמנים, וכתבים שסיקרו את המשפט. לפרטים: סטייסי סאליבן 054-280-7572 או 052-952-2143 `This court has given its stamp of approval to flawed and illegal practices that failed to protect civilian life` - attorney Hussein Abu Hussein’s statement on the verdict in the Rachel Corrie wrongful death lawsuit (Haifa, Israel – August 28, 2012) – While not surprising, this verdict is yet another example of where impunity has prevailed over accountability and fairness. Rachel Corrie was killed while non-violently protesting home demolitions and injustice in Gaza, and today, this court has given its stamp of approval to flawed and illegal practices that failed to protect civilian life. In this regard, the verdict blames the victim based on disotrd facts and it could have been written directly by the state attorneys. We knew from the beginning that we had an uphill battle to get truthful answers and justice, but we are convinced that this verdict distorts the strong evidence presented in court, and contradicts fundamental principles of international law with regard to protection of human rights defenders. In denying justice in Rachel Corrie`s killing, this verdict speaks to the systemic failure to hold the Israeli military accountable for continuing violations of basic human rights.
